Since March 2026, two authorized investment dealers may offer Canadians a narrow set of event contracts covering economic indicators, financial markets and climate, each with a minimum 30 day term. Sports, elections and entertainment contracts are not permitted. No prediction market platform is itself registered or recognized in Canada, and Polymarket is banned in Ontario until at least April 2027.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the whole answer. The rest explains why the rules look this way, which is the part almost nobody gets right.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Were Prediction Markets Illegal in Canada Until 2026?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Two legal frameworks blocked them, and confusing the two produces most of the bad information online.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The binary options ban and the 30 day rule<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In December 2017, Canadian securities regulators brought in Multilateral Instrument 91-102 Prohibition of Binary Options. It prohibits offering or selling to an individual any option containing a yes or no proposition about a future price or event, with a term to maturity under 30 days, that pays a fixed amount if the proposition is met and nothing if it is not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read that definition again. It precisely describes a standard prediction market contract. The rule was written to stop a wave of binary options fraud, and it closed the door on an entire product category before that category became popular.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Criminal Code and the provincial gaming monopoly<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The other door was the Criminal Code, which prohibits lotteries and betting schemes unless they are conducted and managed by a provincial government. That is why every legal sportsbook in Ontario or Alberta operates under a provincial framework rather than a federal licence. An independent platform taking positions from Canadians on future events does not fit inside that exception.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Between the two frameworks there was no lawful space for a prediction market to occupy. That is the honest answer to &#8220;why are prediction markets illegal in Canada&#8221;, in the past tense because it changed in 2026.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Prediction Markets Are Legal in Canada Right Now?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On March 26, 2026, the Canadian Investment Regulatory Organization published Administrative Bulletin 26-0076, <a href=\"https:\/\/www.ciro.ca\/newsroom\/publications\/application-ciro-requirements-event-contracts\" target=\"_blank\" rel=\"noreferrer noopener\">Application of CIRO Requirements to Event Contracts<\/a>. It created a pathway: authorized CIRO Investment Dealer Members may facilitate client trading in a limited set of event contracts traded and cleared through exchanges regulated by the United States Commodity Futures Trading Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The conditions are tight.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The three permitted event contract categories<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Only three subjects are authorized: <strong>economic indicators, financial markets and climate.<\/strong> In practice: central bank rate decisions, inflation data, index and currency levels, listed company results, and temperature or precipitation benchmarks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sports, elections, entertainment and pop culture are not on the list. Those are the categories that made prediction markets famous internationally, and they are exactly what Canadians cannot trade through a dealer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two further constraints apply. Every contract must carry a term to maturity of <strong>30 days or longer<\/strong>, mirroring the binary options ban, and issuing a new threshold on an existing contract counts as a new contract that must also clear 30 days. Dealers may <strong>not<\/strong> permit leverage or margin.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Which dealers are authorized to offer event contracts<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Two, as of this update: <strong>Interactive Brokers Canada Inc.<\/strong>, authorized in 2025 and offering ForecastTrader contracts through ForecastEx, and <strong>Wealthsimple Inc.<\/strong>, authorized in March 2026 and now live with the Wealthsimple Predict app. Any other dealer must notify CIRO in writing and file a material change to business activities application. Questrade has signalled interest but is not among the authorized firms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On April 2, 2026, the CSA and CIRO issued a <a href=\"https:\/\/www.ciro.ca\/newsroom\/publications\/prediction-markets-csa-and-ciro-remind-industry-and-investors-current-rules\" target=\"_blank\" rel=\"noreferrer noopener\">joint reminder<\/a> that anyone trading or facilitating trading in event contracts that are securities or derivatives must satisfy registration and recognition requirements. The dealers are authorized. The prediction markets themselves are not.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is Polymarket Legal in Canada?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Not in Ontario, and not with Canadian approval anywhere else.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On April 17, 2025, the Capital Markets Tribunal approved an <a href=\"https:\/\/www.osc.ca\/en\/news-events\/news\/osc-reaches-settlement-current-and-former-operators-polymarket-breach-binary-options-ban\" target=\"_blank\" rel=\"noreferrer noopener\">OSC settlement with Blockratize Inc. and Adventure One QSS Inc.<\/a>, the current and former operators of Polymarket. Between June 2020 and May 2023 they offered binary options to Ontario investors in breach of MI 91-102. The settlement carried monetary sanctions and two-year market bans, including a bar on trading securities or derivatives, running to April 2027. Polymarket restricted Ontario access in May 2023 at the OSC&#8217;s request and lists Ontario as a blocked region.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Outside Ontario, Polymarket has no CSA registration, no CIRO authorization and no provincial gaming licence. &#8220;Not yet subject to an enforcement order in your province&#8221; is very different from &#8220;legal&#8221;, and carries none of the protections a Canadian dealer relationship does.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A related point, because search results are full of workarounds: bypassing a geographic block breaches the platform&#8217;s terms, can result in frozen balances and forfeited funds, and does not change the legal status of the activity. This article does not explain how.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Are Prediction Markets Legal in Ontario, Alberta and BC?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The securities rules are effectively national. MI 91-102 and the CIRO framework apply across the participating jurisdictions, so a dealer&#8217;s client in Halifax faces the same permitted categories as one in Vancouver.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Provinces diverge on enforcement posture and the gaming side. Ontario has been the most active enforcer, holding the country&#8217;s only prediction market settlement, and runs Canada&#8217;s largest regulated online gambling market. Alberta opened its regulated iGaming market to private operators on July 13, 2026. Those frameworks govern sports betting, not event contracts, and no province currently licenses a peer to peer prediction market as a gaming product.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can Canadians Participate in Prediction Markets Legally?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes, within the boundaries above. Opening an account with an authorized dealer and trading permitted contracts is lawful. The obligations in MI 91-102 and the CIRO bulletin fall on the firms offering these products, not on retail participants. Using an unregistered offshore platform is a different matter: no Canadian protection, and a tax treatment with no CRA guidance behind it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Will Prediction Markets Be Fully Legalized in Canada?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The framework is a controlled first step, not a settled endpoint. Three things decide what comes next.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>More dealers.<\/strong> CIRO built an application process, not a one-time exemption, so the roster of authorized firms should grow. That widens access without changing what can be traded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The category list.<\/strong> Sports is the largest prediction market category globally and is entirely excluded. Expanding it runs straight into provincial gaming jurisdiction, so movement is likelier to come from gaming regulators than securities regulators.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Further guidance.<\/strong> The CSA and CIRO have both said they continue to monitor the space. More guidance could tighten the rules as easily as loosen them. Treat nothing here as permanent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Prediction Markets and Canadian Law: Frequently Asked Questions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Are prediction markets legal in Canada in 2026?<\/strong> Partly. Two CIRO authorized dealers, Interactive Brokers Canada and Wealthsimple, may offer a limited set of event contracts on economic indicators, financial markets and climate, each with a minimum 30 day term. No prediction market platform itself is registered or recognized in Canada.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Why are prediction markets restricted in Canada?<\/strong> Two frameworks apply. MI 91-102 has banned binary options with terms under 30 days since 2017, and the Criminal Code reserves betting schemes to provincial governments. Together they left no lawful space for an open prediction market until CIRO created a narrow pathway in March 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Is Polymarket legal in Canada?<\/strong> Not in Ontario, where an April 2025 OSC settlement imposed bans running to April 2027 and Polymarket geo-blocks the province. Elsewhere in Canada it operates with no CSA or CIRO approval, meaning no Canadian regulatory protection for users.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Can Canadians bet on elections through prediction markets?<\/strong> No. Election and political contracts fall outside the three authorized categories, and no Canadian dealer may offer them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Are prediction markets gambling under Canadian law?<\/strong> The authorized contracts sit in the securities and derivatives lane, regulated by CSA members and CIRO, not the provincial gaming lane. Sports wagering is the reverse: gaming, not securities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Do Canadians break the law by trading on prediction markets?<\/strong> The obligations in MI 91-102 and CIRO&#8217;s framework apply to the firms offering these products, not to individual retail traders. Using an unregistered offshore platform is not an offence in itself, but it means trading without any Canadian protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What is the 30 day rule for prediction markets in Canada?<\/strong> Every permitted event contract must have a term to maturity of at least 30 days.
